Prosecutor Issues Arrest Warrant for Evo Morales for Failing to Appear for Testimony
Tarija’s departmental prosecutor, Sandra Gutiérrez, confirmed that an arrest warrant has been issued against Evo Morales and the parents of the alleged victim after the former president failed to appear for his testimony. According to Gutiérrez, the legal documents presented by Morales’ defense did not prevent him from appearing.
“We are now proceeding according to the law. What follows is issuing the arrest warrant for those who have been duly notified without any violation of their rights. The arrest warrant will be issued so they can appear and provide their informative statement,” said the departmental prosecutor.
“We have drafted the non-appearance report without violating any rights. Public defense was summoned, and now the new team of prosecutors will take the appropriate actions,” the prosecutor said after leaving the Lourdes neighborhood Police Station.
On Thursday, Evo Morales' lawyer, Jorge Pérez, submitted two legal documents to justify the former president's absence, but Gutiérrez clarified that in a criminal process, non-appearance cannot be justified and that they will respond within a reasonable time.
Pérez countered that another arrest warrant would be illegal, arguing that a legal appeal suggests the case should be transferred to the Cochabamba Judicial District, where the former president resides.
In his view, the investigation should not be based in Tarija, according to the Competence Rules of the Code of Criminal Procedure.
